In accordance with the Act 34/2002 of 11 July on Information Society Services and Electronic Commerce, the Foundation Residencia de Estudiantes, with the Company tax code number (CIF) G-79348793, and registered office at 21-23 Pinar St., Madrid (postal code 28006), declare itself a private owned non-profit-making cultural organism, set up by virtue of the Act granted by the Spanish National Research Council (CSIC) on 14 December 1989 and passed on 18 July by Ministerial Order. 2.- USER'S CONSENT
This Conditions relating to the use (from now on “Legal information”) regulate the access to and the use of the Website tienda@edaddeplata.net (from now on the “Web”) offered by la Residencia. Access to the Website implies the acceptance of these general conditions in this Legal information without reservation.
The information and services included or available on la Residencia ‘s Web could be regulate by different particular conditions, about which the customer would be specifically informed.
3.- CONDITIONS RELATING THE USE OF THE WEBSITE AND PASSWORD
In order to access the services provided in this Web, registration as a User is needed. All data entered at registration would be protected under the password chosen by the User. Under any circumstance, neither a license is granted; nor a renunciation, a transfer, or a total or part cession of these rights is to be made; or no right and no legal expectation bestowed, above all, relating to the alteration, exploitation, reproduction, distribution or public communications – placement at public’s disposal modality included – of the said contents without express consent of la Residencia.
The insertion of hyperlinks with commercial purposes in Websites not belonging to la Residencia that allow access to our Web is forbidden unless express consent has been given. In any case, the existence of hyperlinks in Websites not belonging to us does not entail any commercial or mercantile relationship with the owner of the Website hosting the hyperlink, nor the acceptance by la Residencia of its contents or services.
7.- PRIVACY POLICY AND PERSONAL DATA PROTECTION
In accordance with the article 5 of the Spanish Organic Law of Personal Data Protection 15/1999, of 13 December, la Residencia would like to inform the User of the following points:
The personal data that you provide voluntarily through the forms prepared for that purpose on our Web site or in any other channel for collecting them, will be automatically incorporated onto a personal data file which belongs to the FOUNDATION RESIDENCIA DE ESTUDIANTES, a private owned non-profit-making cultural organism, with registered office at 21-23 Pinar St., Madrid (postal code 28006) and with the following e-mail address: tienda@edaddeplata.net.
This file is intended to file and manage the data required for the provision of computer services, maintenance of la Residencia customers relationship. Similarly, the data would be used in order to send the customer commercial communications, including news and articles, and information about the activities offered by the Foundation Residencia de Estudiantes.
The User or his Representative may, at any time, exercise his rights of access, correction, cancellation and opposition in accordance with the Spanish Organic Law Personal Data Protection 15/1999, of 13 December and other applicable law by submitting an electronic request to tienda@edaddeplata.net or by writing a signed request to the following postal address: C/ Pinar 21-23, Madrid (28006). Please, state in the e-mail subject or at the back of the envelope “Protección de Datos de Carácter Personal” (personal data protection) when sending your request.
The request should contain the following personal details: user’s name and surname; a postal address for notifications, a telephone number, a copy of his identification card or Passport and your request. In the event of representation, an irrefutable proff shall be provided.
La Residencia is committed to protecting the data that you provide, to respect the confidentiality of all data supplied, and to make a relevant and reliable use for the purpose it was collected for. As well as reasonable efforts will be made to prevent alteration, loss, data treatment or unauthorised Access to collected information in compliance with Royal Decree 994/1999, giving legal force to the Security Measures Regulations for automated files containing personal data.
8.- ALTERATION OF SERVICE OR AMENDMENTS TO THE CONDITIONS
La Residencia reserves the right to make changes to its website, policies, and this Legal information about our Web at its discretion, unless any change to those policies or these conditions is required to be made by law or government authority.
Such changes will be published in this Web, providing the Users access to them. The User will be subject to the policies and Conditions of Use in force at the time that he uses the Website or that he orders goods from us.
9.- APPLICABLE LEGISLATION AND JURISDICTION:
The relation between la Residencia and the User shall be governed by the legislation in effect in Spain, and any controversy will come under the jurisdiction of the courts of the city of Madrid.
La Residencia shall pursue lack of compliance with current conditions as well as any undue use of its websites by means of all manner of civil and penal actions that may be applicable under the Law.
1.- OBJET AND SPHERE OF APPLICATION
These Terms and Conditions apply to all commercial transactions made on the website of the Foundation Residencia de Estudiantes (from now on “la Residencia”), a private owned non-profit-making cultural organism , with the Company tax code number (CIF) G-79348793, which owns the domain http://tienda.edaddeplata.org (from now on the “Web”).
Likewise, when you place an order to purchase a product or service from la Residencia through its Web, the order is also subject to the Legal Information published on the site. In the event that it comes into conflict with the present Terms and Conditions, the last always prevail under any circumstance.
2.- ACCEPTANCE AND PROOF OF ACCEPTANCE
Any person who wants to access the Site to buy or to use the other features provided must accept the terms and conditions of this Participation Agreement without change. By pressing the "CONFIRM ORDER" button at the bottom of the page during the placement of an order the Customer confirms the acquisition of the product. By taking such an action the User acknowledge that he have read and understood and agree to all of the Terms and Conditions as shown on la Residencia’s website beforehand. Subsequent changes to the clauses of this Terms and Conditions would not apply.
If the Customer wishes to read more carefully the Terms and Conditions, he can print them or download them in an electronic format.
Once the Customer gives the acceptance to the present Terms and Conditions at purchase, la Residencia will send the Customer an e-mail confirming receipt of his order and containing its details.
In the event that a Customer makes a mistake in the data he provides, he can correct it by sending an e-mail to tienda@edaddeplata.net. If the correction is related to the Delivery address and the dispatch process has not started yet, the shipment will be send to the new postal address given by the Customer. Otherwise, the Customer should wait and take delivery of the purchase and, then, start the return procedures.
3.- PRICING, METHODS OF PAYMENT, DISPATCH AND CANCELLATION
3.1.- Pricing
Prices are as listed on the Web at purchase date including the Spanish value-add tax (from now on, IVA). Nevertheless, according to Act 37/19992, of 28 December, which regulates the said tax, the transaction could turn up to be tax-free depending on Customer’s country of residence and upon his status (businessmen/ professional or particular). Therefore, sometimes the final price can vary from the one listed in the Web.
For those deliveries in a State not belonging to the European Union, la Residencia will not be held responsible for any customs duties or taxes applying in other countries, therefore, being at the expense of the Consignee.
We specified in every order, the shipping charges and the IVA applied. Special offers are identified as such. Both, the original price and the special price are stated.
La Residencia reserves the right to operate on the Website at any time, without prior warning, to make alterations consider appropriate, including up-dating products according to the Market.
3.2.- Methods of payment
All purchase can be paid by the following methods of payment:
- COD (cash on delivery): only available for purchases within Spain.
- Credit card (Visa, Master Card or American Express): available in all countries.
3.3.- Delivery
Ordered products will be delivered at the address that the Customer has given us, if the products are available at purchase, within the dispatch estimates as follows depending on the delivery service chosen:
Shipments within Spain
- Regular: aprox. 2-7 working days
- Urgent:: aprox. 1-2 working days
International shipments
- Regular: aprox. 10-20 working days
- Urgent: aprox. 7-10 working days
La Residencia sends the orders to Customers through national and international well-known Delivery firms and the state-owned Mail Service. The Dispatch times depend on the availability of the product ordered and the delivery area.
Before you receive the Dispatch confirmation e-mail you will be informed of the Dispatch estimates. Please note that there are not guaranteed dispatch times and that it could depend upon extraordinary incidents or difficulties in the delivery of the merchandise.

3.4.- Cancellation
Any book can be returned as long as it keeps its original wrapping and condition within 7 working days after the date the item has been delivered. We will refund the relevant part of the purchase price for that item as soon as possible.
You should be aware that once we begin the dispatch process you will not be able to cancel any contract you have with us. You can proceed to return it once you take delivery of it, though. Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. Then, la Residencia will deal with the return and new shipping charges.
If for any reason you are unhappy with your purchase, you can return it to us in its original condition and we will refund the relevant part of the purchase price for the item but not the shipping or return charges. Refunds will be issued to the account number provided by the Customer.

4.- SERVICE REQUIREMENTS
To purchase our products or services the Customer would have to fill in the purchase order form with his personal data and payment details.
Once the Customer places an order, la Residencia will send an e-mail confirming receipt of his order and containing its details and, later on, a payment confirmation to the e-mail address provided by the Customer.
5.- LANGUAGE
The language to be used in the contractual relation between la Residencia and the Customer would be Spanish or, otherwise, English if requested by the Customer.
6.- CORPORATE SOCIAL RESPONSIBILITY
La Residencia guarantees quality of the contracted service through its Web http://tienda.edaddeplata.org. All rights guaranteed by the legislation in force are granted to Customers and Users.
The breach of any of this Terms and Conditions gives the customer the right to return the product or to cancel the services purchased.
7.- CUSTOMER RESPONSIBILITY
As a Customer, you commit to use the access to the services provided by la Residencia in a diligent and correct manner and according to the legislation in force and with no damage to the rights and interests of third parties.
As a Customer, you guarantee that the information provided when filling the contractual forms will be true and correct to avoid damage to la Residencia as a result of a mistake on the said data.
The breach of any of this Terms and Conditions could provoke the withdrawal or cancellation of the services offered by la Residencia without prior warning and without entitling whatsoever compensation.
8.- PERSONAL DATA AND COMMERCIAL COMMUNICATIONS
In accordance with the article 5 of the Spanish Organic Law of Personal Data Protection 15/1999, of 13 December, la Residencia would like to inform the Customer that the personal data voluntarily provided will be incorporated onto a personal data file which belongs to la Residencia and will be used to handle orders, deliver products and services, and the promotion of the products offered in an electronic or a written format.
The Customer may, at any time, exercise his rights of access, correction, cancellation, opposition and may revoke his consent to receive electronic commercial communications by writing a signed request to la Residencia to the following postal address: C/ Pinar 21-23, Madrid (28006), or by submitting an electronic request to la Residencia at tienda@edaddeplata.net
9.- INDUSTRIAL AND INTELLECTURAL PROPERTY
Industrial and Intellectual property of the contents, such as works, brands, logos, and whichever other signs susceptible of protection included on la Residencia‘s Website are the exclusive property of la Residencia or of any other third party authorizing its inclusion on the Web. The non-authorized reproduction, distribution, commercialization or transformation of such works, brands, logos, and etcetera constitute an infringement of la Residencia or any other holder’s industrial and/or intellectual property rights and may result in the corresponding legal actions being taken. Likewise, the information provided in the Web could be protected by rights of industrial or intellectual property or of any other nature. In no case or under any circumstance, la Residencia would be held responsible for the infringement of the said rights you commit as a User.
10.- APPLICABLE LEGISLATION AND JURISDICTION
In the event of a conflict or a discrepancy in the interpretation or application of the present contractual conditions, it will be submitted to the competent Courts and Tribunals to consider such matters as they apply to final consumers, in the place where such obligation is to be carried out or the purchasing party's place of domicile.
In the event of a business transfer, the parties, expressly renouncing any other medium that may be applicable to them, expressly submit to the jurisdiction of the lower and upper courts of the city of Madrid.

The process of payment by debit or credit card is done directly with the virtual POS terminal of the issuing bank (or Credit Card association).
